This software is developed and provided by ASSYST Inc, for its direct customers. Any use of this software by other parties, in whole or in part, is done at the sole discretion and risk of the parties.

ASSYST Inc makes no warranties, express or implied, regarding the performance, functionality, or reliability of this software. The software is provided "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose (as per Uniform Commercial Code Sections 2-312 and 2-316), and non-infringement.

By using this software, the user acknowledges and agrees that ASSYST Inc, as well as any of its customers sharing similar code, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including but not limited to damages as outlined under Title 17 of the United States Code), resulting from the use or the inability to use the software.

The user further agrees to indemnify and hold harmless ASSYST Inc and its customers sharing similar code, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from their use of the software or their breach of this disclaimer. This provision is in compliance with applicable laws, including the Computer Fraud and Abuse Act (CFAA).

This disclaimer is subject to the prevailing laws and regulations, including international agreements such as the Berne Convention for the Protection of Literary and Artistic Works, and is enforceable to the extent permitted by law.

This disclaimer constitutes the entire agreement between the parties and ASSYST Inc regarding the use of the software, superseding any prior agreements between the parties and ASSYST Inc.
