the atf will issue temporary, non-resident serial numbers to registered firearms dealers that meet certain criteria, but the dealer must submit an application and receive approval before the atf will issue the serial number.

the law is clear. the only way to have a serial number on a firearm is to engrave, cast, stamp (impress), or otherwise conspicuously place or cause to be engraved, cast, stamped (impressed), or placed on the frame or receiver of the firearm a unique serial number, not duplicative of any number already placed on the frame or receiver by you. if you violate this requirement, you may be fined $5,000 or imprisoned for not more than five years, or both. those of you who import destructive devices are under the same requirement due to the inclusion of destructive devices in the definition of firearm as used in 27 cfr 178.11 c . atf ruling 75-28 also reminds you of the other identifying marks required by 27 cfr 178.92 c .

perhaps that is the only reasonable definition of duplicative. whatever it is, it is not sufficient to have a serial number that is “similar to but not the same as” the serial number on another firearm that you imported into the united states.

to be clear, you can have a serial number that is almost the same as, but not the same as, another number. for example, you can have a number that includes three numbers and a fourth number that begins with 0, or you can have a number that includes three numbers and a fourth number that begins with 1.

let’s assume that you have two firearms that are identical except for their serial numbers. the second serial number is a perfect duplication of the first. you can’t have both firearms in the united states. you cannot lawfully have one firearm with a first serial number of 099239 and another firearm with a first serial number of 099239. having two firearms with the same first serial number is illegal under federal law. likewise, the law prohibits you from having two firearms with the same first serial number and having imported the second firearm into the united states. you can’t lawfully have two firearms with the same first serial number. if you have two firearms with the same first serial number and both have been imported into the united states, atf will seize both firearms. the violation is a felony punishable by a fine of $5,000 and up to five years in prison. 84d34552a1
