In the latest regulatory framework, stressed assets that entail risks to a banking system would be identified by a special nodal platform, an Asset Quality Review, which is a tripartite mechanism involving banks, non-bank lenders and Reserve Bank of India as the third party. Based on the Asset Quality Review, banks can enter into a Memorandum of Understanding (MOU) with the Principal Borrower, a bank would be able to sell or transfer the secured or non-performing assets to an asset reconstruction company or negotiate a plan of settlement with the principal borrower or immediate sale and clearing of the asset in case of a mutual agreement with the Principal Borrower. The regulation provides for a floor pricing mechanism as well as a ceiling price for sale of the assets. The RBI has established an Asset Quality Review Committee and a High Level Lending Group as mandated by the NAC to do the Asset Quality Review. Individual banks can also propose alternative measures of managing stressed assets, depending upon the nature of their asset quality, risk appetite, and their internal policies.

Stressed assets include assets of a borrower that are classified as non-performing asset (NPA), e.g. loans of below Rs. 50 Lakh that are more than 180 days of the reporting period, and assets of a borrower whose repayment capacity is impaired, e.g., projects with EMI around the time of loan disbursement that have significant shortfall in construction and completion, or accounts of a borrower that are classified as bad or doubtful.

Another major feature of the Amendment is the introduction of a single consolidated WSA for the entire banking industry so as to compute a common credit index that will be used to determine and benchmark the lending and borrowing performance of banks. 84d34552a1
