there has been an increasing attention to unaccompanied minors over the last 20 years, not only in academic but also policy debates. this is a product of a shift in policy, not only in the european union but also in national governments worldwide, towards more restrictive and restrictive policies towards children and families entering europe as well as increasing restrictions on asylum seekers. the eus asylum directive 2013/33/eu was one of the first european laws that targeted unaccompanied minors, providing the framework for the processing of asylum claims and identifying unaccompanied minors as vulnerable groups. the directive also made it easier for states to send back unaccompanied minors to countries where they have a well-founded fear of persecution (eu asylum directive 2013/33/eu).


if the eus asylum directive 2013/33/eu is seen as an attempt to provide a framework for the reception of unaccompanied minors, the european comission s european justice and home affairs council 2019/2022 white paper is a milestone in the development of the union. it presents the development of the eus asylum system as a key element of its legal system. the white paper recognises that a number of challenges need to be addressed in order to fully meet the needs of unaccompanied minors. for example, the paper proposes that more guidance should be given on the cases of unaccompanied minors in the context of family reunification. it also calls on the eu to address their protection and reception obligations within the union.


the same year that the european qualification directive was adopted, the european commission also released a communication on the reception of unaccompanied minors, which was very much geared towards a mainstream audience. it contained a number of recommendations on how member states can and should address the reception of unaccompanied minors. it suggested that member states should work towards providing accommodation for unaccompanied minors in the country of reception, and should ensure adequate facilities to ensure their safety. more importantly, the commission recommended that member states should provide for the reception and care of unaccompanied minors in a sensitive, safe and non-discriminatory manner (european commission 2011 ). this strategy for the reception of unaccompanied minors emphasised the importance of dealing with these young asylum seekers as children, by setting out the rights and obligations of member states in line with the un convention on the rights of the child. while unaccompanied minors still occupy a specific place in the legal order of things, their importance in public discourse and in the imagination of eu citizens has increased considerably since 2011. in the eu, it has become increasingly common for the term unaccompanied minor to be used as a generic reference to all unaccompanied asylum seekers, including young adults. 84d34552a1
